By now, you may have received news in regards to the upcoming PACT Act and vape mail restrictions, especially in regards to USPS, FedEx, and UPS. We want to offer some clarity on how this may affect the vape shipments moving forward.
Element Vape is committed to serving the vaping community and will continue to operate to serve our customers. Our team will be working with specialist carriers to build an extensive network of regional and local carriers for shipping deliveries, while adhering to compliance with State and Federal laws.
What is the PACT Act?
In December 2020, a congressional amendment to the PACT Act was signed into the law as part of the omnibus spending bill. The effect of this new law broadens the definition of tobacco products to include electronic cigarettes, vapes, E-Liquids, and vaping accessories.
Starting March 27, 2021 the PACT will require online retailers to collect state and local excise taxes on vaping products and require Adult Signature on all deliveries nationwide. Other compliance requirements includes labeling and packaging, record-keeping, and State and Federal registration and reporting.
Furthermore, USPS will be prohibited from accepting packages of vapor products. Unfortunately, FedEx and UPS have voluntarily issued internal policy changes to stop the shipment of vapor products as well.
For your information, these carriers are expected to stop shipping vape products starting the following dates:
-FedEx, March 1
-UPS, April 5
-U.S. Postal Service (USPS), October 21
Additionally. all packages containing vapor related items will require Adult Signature (21+) upon delivery and will include a $7 Carrier's Fee at checkout. You can read more about the service here:

Coverage will be limited and not all areas of the continental U.S. will be serviced. However, as the network expands, we will make sure shipping services are made available as soon as possible so hang on tight! Customers can verify if their location falls within our shipping network on our page here.
Please keep in mind that each City/State will have their own regulations that may prohibit us from shipping certain items to your location. You may encounter an error message during our checkout process in the event that your cart contains restricted items.
In the meantime, we recommend customers to stock up on vaping gears and E-Liquids to ensure adequate inventory reserve while shipping operations are still normal.
